Consumer Terms and Conditions

Read This Agreement Carefully Before Using Our Internet Services.

1. Introduction.

Nationwide Internet provides its Internet services, as they may exist from time to time ("Services"), to users who pay a service fee to subscribe to the Services ("Subscribers") as well as to those who access some of our Services but do not have accounts ("Visitors"). By establishing an account or using the Services, you agree to be bound by this Agreement and to use the Services in compliance with this Agreement. If you do not agree to the terms and conditions of this Agreement, including any future revisions, you may not use the Services and if you are a current Member, you must terminate your use of the Services under Section 9.

2. Subscriber Conditions.

Primary account holders for dial-up services must be at least 18 years of age. Local Access numbers may not be available in all areas. A list of available access numbers is posted on the nationwide.net website. You are solely responsible for determining if use of a particular dial-up number will cause you to incur long-distance, toll, or other charges. Nationwide Internet is not responsible for any long-distance, toll or other telecommunications charges you incur. Nationwide Internet reserves the right to change prices and institute new fees at any time with at least 30 days prior notice. Subscribers of DSL Services must be at least 18 years of age. Services must be available at your location. Subscriber must keep their telephone service active in for the Services to work and are responsible for charges for the Services regardless of the status of your underlying telephone service. Changing telephone service providers will result in substantial interruption of the Services and will result in fees associated with cancellation and setting up a new account.

3. Payment Obligations of Subscribers.

(A)Subscribers must provide Nationwide Internet with current and accurate billing information. Including, but not limited to, legal name, address, telephone number, and credit card or billing information.
(B)Subscribers must inform Nationwide Internet of any changes to above information and subscribers are responsible for all charges to their account.
(C)Subscribers with questions regarding charges to their account should contact customer service at 1.888.628.4669 #2. All charges are considered valid unless disputed in writing within thirty (30) days of the billing date. No adjustments will be made for charges older than thirty (30) days.
(D)Charges are billed to Subscribers' credit cards or debit cards, as applicable, for each month's service and any additional usage or services. Nationwide Internet is not responsible for any charges or expenses (e.g. for overdrawn accounts, exceeding credit card limits, etc.) resulting from charges billed by Nationwide Internet.
(E)If paying by check or money order, payment is due the on the 1st day of the month for which the subscription is to start. Checks and/or money orders that are returned by the back for any reason will incur $30 returned check fee.
(F)Delinquent accounts may be suspended or canceled at Nationwide Internet sole discretion; however, charges will continue to accrue until the account is canceled. Nationwide Internet may bill an additional charge to reinstate a suspended account.
(G)Nationwide Internet may charge for taxes and other applicable fees.

4. Subscribers Account, Security, and Password.

Upon registration, Subscribers receive a username, password, and account designation. You and members of your household are the only authorized users of your Nationwide Internet account and must comply with this Agreement. You must keep your password confidential so that no one else may access the Services through your account. You must notify Nationwide Internet immediately upon discovering any unauthorized use of your account. Using a personal account for high volume or commercial use (e.g., revenue generation, advertising, etc.) is prohibited. Email accounts exceeding the Subscribers allotted email space may, at Nationwide Internet discretion, be transferred to a compressed temporary file or storage. Nationwide Internet may delete the temporary file from the server 60 days after notifying you. Any free Web site exceeding the amount of space allotted to such Member may be suspended until the Subscriber reduces the disk space usage to the amount of space allotted or less or purchases additional megabytes. Any free Web site exceeding the traffic limits for such Subscriber will be billed for excess traffic. You may establish a commercial or high-volume account by calling 1.888.628.4669

209.320.4690. Subscribers agree not to use any automatic method to avoid inactivity disconnect or to otherwise maintain a connection unless actively using it. Members agree not to provide any public information services over a dial-up connection. Nationwide Internet may change its POP numbers at any time. Nationwide Internet reserves the right to direct Subscribers to use certain numbers to access the Service or to restrict use of specific access numbers. Usernames, passwords and email addresses are Nationwide Internet's property and Nationwide Internet may alter or replace them at any time.

5. Monitoring Service.

Nationwide Internet has no obligation to monitor the Services, but may do so and disclose information regarding use of the Services for any reason if Nationwide Internet, in its sole discretion, believes that it is reasonable to do so, including to: satisfy laws, regulations, or governmental or legal requests; operate the Services properly; or protect itself and its Subscribers.

6. Disclaimer of Warranties and Limitation of Liability.

EXCEPT FOR CERTAIN PRODUCTS AND SERVICES SPECIFICALLY IDENTIFIED AS BEING OFFERED BY NATIONWIDE INTERNET, NATIONWIDE INTERNET DOES NOT CONTROL ANY MATERIALS, INFORMATION, PRODUCTS, OR SERVICES ON THE INTERNET. THE INTERNET CONTAINS UNEDITED MATERIALS, SOME OF WHICH ARE SEXUALLY EXPLICIT OR MAY BE OFFENSIVE TO YOU. NATIONWIDE INTERNET HAS NO CONTROL OVER AND ACCEPTS NO RESPONSIBILITY FOR SUCH MATERIALS. YOU ASSUME FULL RESPONSIBILITY AND RISK FOR USE OF THE SERVICES AND THE INTERNET AND ARE SOLELY RESPONSIBLE FOR EVALUATING THE ACCURACY, COMPLETENESS, AND USEFULNESS OF ALL SERVICES, PRODUCTS, AND OTHER INFORMATION, AND THE QUALITY AND MERCHANTABILITY OF ALL MERCHANDISE PROVIDED THROUGH THE SERVICE OR THE INTERNET. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. NATIONWIDE INTERNET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NATIONWIDE INTERNET MAKES NO EXPRESS WARRANTIES AND WAIVES ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH NATIONWIDE INTERNET OR THE INTERNET GENERALLY. NO ADVICE OR INFORMATION GIVEN BY NATIONWIDE INTERNET OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY. NATIONWIDE INTERNET AND ITS EMPLOYEES ARE NOT LIABLE FOR ANY COSTS OR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM YOUR USE OF THE SERVICES OR THE INTERNET INCLUDING ANY INDIRECT, INCIDENTAL, EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

7. Term of Agreement.

Your Internet access runs a minimum of one month (30 days) from the 1st of the following month; your first month will be prorated to bring your anniversary date to the first of the month. After this prorated charge, your account will be billed the normal access rate for subsequent months. All accounts are to be paid a month in advance. If you elect the three-month, six-month or yearly payment plan, please keep in mind that no refunds are given and that you are obligated for that time frame. Continued use of the Services constitutes acceptance of this Agreement and any future versions. If you are dissatisfied with the Services or any related terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the Services and, if you are a Subscriber, to terminate your account. Please do not assume that we terminate your account for non-use. It is your responsibility to notify us that you no longer want your account.

Nationwide Internet does exercise the right to terminate an account without attempting to contact you first if the policies we have set are not followed.

8. Billing.

Each billing statement will contain all charges for the next account period, plus any charges incurred during the previous period. Each subscriber is separately responsible for any and all local and long-distance telephone charges occurred while using Nationwide Internet services. Any billing, which remains unpaid thirty (30) days after delivery date of billing, will be considered delinquent and the account will be suspended, and all services will be discontinued. No service will be restored until any and all charges are paid in full. Nationwide Internet may re-connect such service subject to the same terms and conditions, and amendments, in effect at time the account was originally opened. In the event Services are at any time suspended for failure to pay fees, the subscribers' account may be subject to a reconnection fee when Services are restored. Subscriber acknowledges that there is a thirty (30) day minimum subscription period, which means no full or partial refund of the initial month's service fee and activation fee will be given if service is canceled within the thirty (30) day subscription period. It is your responsibility to call our billing department if you have updated information (i.e. new expiration date or new credit card).

9. Termination of Services.

You may terminate your account at any time and for any reason by providing a REQUIRED written and signed 30 day notice and delivering that notice in one of the following ways. 10. Refunds.

Nationwide Internet will offer a full refund for up to fifteen (15) days after the initial start of service. After that no refunds will be issued. Nationwide Internet will not make any refunds for subscriber's early termination of any quarterly, semi-annual, or annual accounts.

11. Service Level Agreement.

Nationwide Internet Service shall be accessible to subscribers twenty-four (24) hours a day, seven (7) days a week, except for scheduled maintenance and required repairs, and except for any loss or interruption due to causes beyond the control of Nationwide Internet or which are not reasonably foreseeable by Nationwide Internet, including, but not limited to, interruption or failure of telecommunication or digital transmission links and Internet slow-downs or failures. In the event of any loss or interruption of Internet Services, Subscribers sole and exclusive remedy and Nationwide Internet's sole and exclusive liability for any loss or interruption of Internet Services shall be as follows: for loss or interruption of Internet Services which is due to (i) causes other than scheduled maintenance and required repairs, or (ii) causes beyond the control of Nationwide Internet, or (iii) causes which are not reasonably foreseeable by Nationwide Internet, including, but not limited to, interruption or failure of telecommunication or digital transmission links and Internet slow-downs or failures, which loss or interruption exceeds a continual period of twenty-four (24) hours, Nationwide Internet shall extend the Term of Services a period equal to the period Services have been unavailable to the subscriber.

Should you wish to cancel any of your services provided by Nationwide Internet or any Nationwide Internet Company, you must either Email us at cancels@nationwide.net or fax your request to 877.228.8988 or mail a request to the address below.

Customers may cancel service for any reason, but must do so by notifying Nationwide prior to the end of the cancelled service's current billing period to avoid further charges. Notification will be accepted via email, fax, or letter.

Confirmation of cancellation must be received by customer for cancellation to be effective. Nationwide is not responsible for unconfirmed cancellations and will not refund charges for unconfirmed cancellations. Customers canceling service within the money back guarantee period (within 30 days of initial signup) will have their monthly service fee fully refunded; the set-up fee is not refundable.

Customers who cancel a pre-paid account plan (3 months, 6 months, 1 year plans) after the first 30 days of service will not receive a refund of any unused fees.

13. DSL Cancellation Terms & Conditions.

Should you wish to terminate your DSL Services with Nationwide Internet or any Nationwide Internet Companies, you must submit a signed cancellation notice via postal mail or FAX. Please note our cancellation TOLL FREE FAX Number is 877.228.8988.

For customers that have contract services, the terms of your contract will govern how the services can be canceled and under what circumstances.
